ANTENUPTIAL CONTRACTS

The importance of an Antenuptial Contract

  • It helps protect each partner’s assets
  • It is a vital legal tool that prevents automatic joint ownership of property and debts
  • It clarifies financial responsibilities, and
  • It ensures certainty and security within the marriage

To be valid, the Antenuptial Contract must be signed before the wedding, in the presence of a Notary who is the only professional legally authorized to execute it.
After signing the Antenuptial Contract, it must be registered at the Deeds Office within three months.

If you are unable to sign the contract in person before a Notary, we will provided you with a Power of Attorney, allowing a trusted individual to sign the Antenuptial Contract on your behalf.

South Africa has three marriage regimes consisting of the following:

Marriage in Community of Property

The general understanding here is that the man and woman become bound co-owners in undivided and indivisible half shares of all assets and liabilities at the moment of marriage, as well as of all assets and liabilities that come to them during the marriage. At the moment of marriage, the separate estates merge by operation of law. Upon dissolution of the marriage, the liabilities are settled from the joint estate.

In other words, before the marriage there are two separate estates, each with its own assets and liabilities. After marriage, this becomes one estate, which is called the joint estate and the parties are joint owners of the assets in the estate and also jointly liable for the debts (both existing at the time of marriage and future debts).

The disadvantage here is the joint liability for debts of the joint estate. If no antenuptial contract is entered into, a marriage will automatically be in community of property.

Marriage out of Community of Property without Accrual

This is the form of matrimonial property system where, by way of a notarial antenuptial contract, community of property and community of profit and loss are excluded. The accrual system is explicitly excluded, and legal equality is achieved in that each party has full control over his/her assets (i.e., separate estates, and no need for prior consent from the other spouse).

This is mostly used in cases where both parties already have significant estates or income, or in the case of second marriages.

The disadvantage here is that the husband and wife will have no claims against each other, regardless of whether there was growth in one or both estates. There are separate estates, and each party manages his or her own estate. However, this does not mean that the husband or wife will not or cannot have a maintenance claim at the termination of the marriage.

Marriage out of Community of Property with Accrual

There is also a notarial antenuptial contract, and during the existence of the marriage, it is out of community of property and out of community of profit and loss (as described above). Each party retains their own estate, but at the dissolution of the marriage, the spouses share equally in the accrual (growth) that both estates experienced during the marriage.

Assets obtained by the parties before the marriage can be excluded from the accrual (if no assets or starting values are mentioned as being excluded in the antenuptial contract, it is assumed that the starting value of each estate is zero).

The parties still have separate estates, but at the dissolution of the marriage, the net value of each estate is determined separately, and the estate with the greater accrual must transfer half the difference in growth to the estate with the smaller accrual.
